Major International Hacker Pleads Guilty For Massive Attack on U.S. Retail and Banking Networks

WASHINGTON, Dec. 29 /PRNewswire-USNewswire/ -- Albert Gonzalez, 28, of Miami, pleaded guilty today to conspiring to hack into computer networks supporting major American retail and financial organizations, and to steal data relating to tens of millions of credit and debit cards, announced Assistant Attorney General of the Criminal Division Lanny A. Breuer, U.S. Attorney for the District of New Jersey Paul J. Fishman, U.S. Attorney for the District of Massachusetts Carmen Milagros Ortiz and Director of the U.S. Secret Service Mark Sullivan.


Gonzalez, aka "segvec," "soupnazi" and "j4guar17," pleaded guilty to two counts of conspiracy to gain unauthorized access to the payment card networks operated by, among others, Heartland Payment Systems, a New Jersey-based card processor; 7-Eleven, a Texas-based nationwide convenience store chain; and Hannaford Brothers Co. Inc., a Maine-based supermarket chain. The plea was entered in federal court in Boston before U.S. District Court Judge Douglas P. Woodlock. The case is one of the largest data breaches ever investigated and prosecuted in the United States.


According to information contained in the plea agreement, Gonzalez leased or otherwise controlled several servers, or "hacking platforms," and gave access to these servers to other hackers, knowing that they would use them to store malicious software, or "malware," and launch attacks against corporate victims. Malware used against several of the corporate victims was also found on a server controlled by Gonzalez. Gonzalez tested malware by running multiple anti-virus programs in an attempt to ascertain if the programs detected the malware. According to information in the plea agreement, it was foreseeable to Gonzalez that his co-conspirators would use malware to steal tens of millions of credit and debit card numbers, affecting more than 250 financial institutions. Gonzalez was indicted in New Jersey in August 2009 for this criminal conduct.


Based on the terms of the plea agreement, Gonzalez will not seek a prison term under 17 years and the government will not seek a prison term of more than 25 years. Gonzalez pleaded guilty in September 2009 in Boston to 19 counts of conspiracy, computer fraud, wire fraud, access device fraud and aggravated identity theft relating to hacks into numerous major U.S. retailers including TJX Companies, BJ's Wholesale Club, OfficeMax, Boston Market, Barnes & Noble and Sports Authority. Gonzalez was indicted for those offenses in August 2008 in the District of Massachusetts. Gonzalez also pleaded guilty in September 2009 in Boston to one count of conspiracy to commit wire fraud relating to hacks into the Dave & Buster's restaurant chain, which were the subject of a May 2008 indictment in the Eastern District of New York.


As part of the plea agreement with the government, the New Jersey case was transferred to the District of Massachusetts for plea and sentencing. According to the terms of the New Jersey plea agreement, the parties agree that Gonzalez' sentence in the New Jersey case should run concurrently with the sentence imposed in the Boston and New York cases. Gonzalez remains in federal custody. Sentencing in the Boston and New York cases is currently scheduled for March 18, 2010, in Boston. Sentencing in the New Jersey case is scheduled for March 19, 2010.

Indeed, with timely reporting of data breaches and high-tech investigations, even the most sophisticated hacking rings can be uncovered and dismantled, as our prosecutors and agents demonstrated in this case."

"But time and again they are caught, prosecuted and sentenced to lengthy federal prison terms. Other hackers should sit up and take notice."


"The conviction of Mr. Gonzalez, and the unraveling of one of the most complex and large scale identity theft cases in history, should serve as a reminder to hacker organizations, that the Department of Justice will vigorously investigate and prosecute cybercrimes, regardless of their sophistication and global reach. Mr. Gonzalez's conviction is the result of unprecedented coordination across agency and geographical lines, and I want to commend the investigators and prosecutors who have worked tirelessly to bring this case to fruition," said U.S. Attorney Ortiz of the District of Massachusetts.


"Today's plea proves that although cyber criminals can threaten our nation's financial sector, the Secret Service and its many partners around the world will pursue and prosecute them," said U.S. Secret Service Director Sullivan. "Time and again, cooperation and advanced methodologies have allowed us to focus our resources in order to detect and prevent these types of crimes, wherever they originate."


The New Jersey case is being prosecuted by Assistant U.S. Attorneys Erez Liebermann and Seth Kosto of the District of New Jersey, Assistant U.S. Attorneys Stephen Heymann and Donald Cabell of the District of Massachusetts, and Senior Counsel Kimberly Kiefer Peretti of the Criminal Division's Computer Crime and Intellectual Property Section. All of these cases are being investigated by the U.S. Secret Service.

Delta Air Lines Issues Statement on Northwest Flight 253

ATLANTA, Dec. 25 /PRNewswire-FirstCall/ -- Delta Air Lines (NYSE:DAL) today issued a statement regarding the incident onboard Northwest Airlines Flight 253 bound for Detroit Metropolitan Wayne County Airport from Amsterdam.


"Upon approach to Detroit, a passenger caused a disturbance onboard Northwest Airlines Flight 253. The passenger was subdued immediately and the crew requested that law enforcement meet the flight upon arrival. The flight, operated by Northwest using an Airbus 330-300 aircraft with 278 passengers onboard, landed safely. The passenger was taken into custody and questioned by law enforcement authorities. Delta is cooperating fully with authorities and additional questions should be directed to law enforcement officials who are leading the investigation."

Barack Obama Praises US Senate for Historic Health Reform Bill

Millions of Americans could not have asked for a better Christmas present than the historic passage of the Health Reform Bill by the US Senate on Thursday December 24, 2009.

The primary purpose of H.R.3200 - America's Affordable Health Choices Act of 2009 is:
"To provide affordable, quality health care for all Americans and reduce the growth in health care spending, and for other purposes."

It was a triumphant Christmas Eve for President Barack Obama who praised the US Senate for passing the bill and asked for more cooperation and support to enable him sign the reform into law.

Although it's Christmas Eve, I wanted to share some exciting news: The Senate just passed a historic health reform bill.

In all the back and forth, it's easy to lose sight of what this incredible breakthrough really means. But consider this: This Christmas, there are millions of Americans without health insurance who risk losing everything if they get sick.

There are mothers and fathers who wonder how they'll provide for their children because an illness has wiped out their savings. There are small business owners who worry that they'll have to lay off a long-time employee because the cost of insurance is rapidly rising.

If we finish the job, all this can change. We will have beaten back the special interests who have for so long perpetuated the status quo. We will have enacted the most important piece of social policy since the Social Security Act in the 1930s, and the most important health reform since Medicare in the 1960s.

As part of her visit on Tuesday, Mrs. Obama and her daughters read stories to children staying at the hospital who were brought down to the hospital atrium for the annual event.

The Worst Scandal of 2009: Big Money in Politics

What was the biggest scandal of 2009?


Blagojevich trying to sell a Senate seat? Senators, governors, and their mistresses? Allegations that lobbyists were lining up defense earmarks in exchange for straw donations?


No, the biggest scandal of 2009 was that the entire pay-to-play system that dominates Washington and occupies Congress' time and attention sidetracked bold policies.


One year after President Obama was swept into office on a ticket of change, a wall of big money from the health interests, banks, and Big Oil thwarted, slowed, or deep-sixed legislation in Washington. Special interests were on track to spend $3.3 billion to shape policy outcomes, according to a recent story in Politico. Despite the voters' mandate for change, the underlying problem of Washington - what author and Washington Post reporter Robert Kaiser calls "too damn much money" - remained unaltered and in many ways, more powerful than ever before.


The bottom line is that America will not see the significant change that a majority of people are demanding until we change the way we pay for political campaigns by getting special interests out of the business of paying for our elections.


"Yes we can" has been blocked by "no you don't."

Here are some facts to consider:

-- The health care debate is a perfect example of all that is wrong.
Everyone agrees health care must be made more affordable, and that
more people need coverage. But with the health care industry spending
more than $1 million a day this year to lobby for their bottom line,
and contributing more than $200 million to candidates for Congress in
the 2008 election cycle and first nine months of 2009, it's not a
surprise that reform proposals were watered down.
-- At the beginning of December, the U.S. House passed legislation to
reform the financial regulatory industry. The vote came fifteen months
after the collapse of the financial sector and the $700 billion
bailout of Wall Street banks. Reform of Wall Street shouldn't have
been so hard -- these firms exploited a weak regulatory regime to
wreak havoc on our economy -- but throughout 2009, financial, real
estate, and insurance interests poured $85 million in campaign
contributions into Washington, D.C. They succeeded at watering down
sections of the House bill, and have declared all out war on the
Senate bill.
-- As the climate change conference in Copenhagen comes to a close,
President Barack Obama's hands were tied not just by China and India's
unwillingness to negotiate far-reaching agreements. He was also hemmed
in by the politics of passing climate legislation through the U.S.
Senate - and the stranglehold that Big Oil and coal companies have
over our elected officials. The energy sector has contributed more
than $4.5 million to Senators just this year - an off-election year.
Senators like Jim Inhofe (R-Okla.) have declared that any action on
climate change in the Senate faces an uncertain future. Inhofe has
received more than $1.2 million in contributions from oil and gas
interests during his career.


The swamp of special interest money is rising in Washington and Congress needs a way out.


The Solution: The Fair Elections Now Act


One year later, it's become clear that change doesn't come simply with the election of a new president or new members of Congress. To dramatically change the way Washington works we need to change the way campaigns are financed in this country.


It's time for the Fair Elections Now Act (S. 752, H.R. 1826), legislation that would sever the ties between big money campaign contributors and members of Congress. With Fair Elections, candidates would be able to run a competitive race for congressional office with a blend of small dollar donations and limited public funds. Sponsored by Sen. Dick Durbin (D-Ill.) and Rep. John Larson (D-Conn.), this voluntary system would put people in office unencumbered by special interest influence. In addition to Rep. Larson, the House bill has the broad bipartisan and cross-caucus support of 124 members.


There have been a lot of political scandals and intrigue in Washington this year, but the worst of them all is the sordid impact of money in our political process. The scandal is what is legally permitted day in, day out, in Washington, D.C. It is time to change the system and pass the Fair Election Now Act.

AMA Announces Support for Passage of Senate Health Reform Bill

WASHINGTON, Dec. 21 /PRNewswire-USNewswire/ -- The American Medical Association (AMA) today announced its support for passage of the amended Senate health system reform bill (H.R. 3590). Passage of the Patient Protection and Affordable Care Act by the Senate will bring our nation close to the finish line on health system reform.

Better health care for all Americans

"All Americans deserve affordable, high-quality health coverage so they can get the medical care they need - and this bill advances many of our priority issues for achieving the vision of a health system that works for patients and physicians," said AMA President-elect Cecil B. Wilson, M.D.


The Senate bill includes a number of key benefits for meaningful reform. It will improve choice and access to affordable health insurance coverage and eliminate denials based on pre-existing conditions. The bill will increase coverage for preventive and wellness care that can lead to better disease prevention and management, and further the development of comparative effectiveness research that can help patients and physicians make informed treatment decisions. "Lifetime limits on health coverage will be a thing of the past - as will higher premiums based on medical conditions or gender," said Dr. Wilson. "These are important benefits for those who have insurance now - and those who want it but have been unable to get it."


"The AMA communicated closely with the Senate about items it supported and items of concern in the prior version of the Senate bill," said Dr. Wilson. "We are pleased that the manager's amendment addresses several issues of concern to AMA. It increases payments to primary care physicians and general surgeons in underserved areas while no longer cutting payments to other physicians. It eliminates the tax on physician services for cosmetic surgery and drops the proposed physician enrollment fee for Medicare."


While important improvements have been made to the bill, there is still work to be done, and AMA will continue its advocacy on behalf of patients and physicians through the conference process. Important issues that need to be resolved in the House-Senate conference committee include the creation of a Medicare payment board, quality improvement and Medicare data release initiatives. Separate action is needed early next year to permanently repeal the current Medicare physician payment formula to provide a stable payment system to preserve access to care for America's seniors, baby boomers and military families.


"The AMA will stay engaged in the process to ensure that the final bill that goes to President Obama for his signature will improve the health care system for patients and physicians," said Dr. Wilson.

FRC Asks - 'Is There No Democratic Senator Who Cares About Life?'

WASHINGTON, Dec. 21 /PRNewswire-USNewswire/ -- Early this morning, the U.S. Senate voted for cloture on the manager's amendment which includes abortion language that would force the federal government to pay premiums for private health plans that will cover any or all abortions while doing nothing to protect individual conscience rights. Beyond the issue of abortion, the legislation has a myriad of other problems including increasing taxes on families while singling out and penalizing married couples through an increase in the payroll tax. Cuts to Medicare and the expansion of the federal role in personal health care decisions will inevitably lead to rationing of care for patients.

Family Research Council President Tony Perkins had this to say about the legislation:


"While true health care reform is needed, this legislation does nothing to alleviate the problems facing American families. Under this bill, families face an increasing tax burden that will be used to further devalue human life. A federal government run health care system will create a nationwide abortion network funded by government dollars resulting in the greatest abortion expansion since Roe v. Wade.


"The Senate's cloture vote reflects the whole process leading up to it - ugly, partisan and dangerous. This legislation was drafted by a handful of people, supported by only one political party and will negatively affect every single American citizen.


"What is most disappointing is that while some Democrats in the House of Representatives put the sanctity of human life first and foremost, not one Senator from the Democratic Party could be bothered to stand up for mothers and their unborn children.


"Senators Ben Nelson (D-Nebr.) and Robert Casey (D-Penn.) gave mere lip service to protect the most innocent among us by placing their stamp of approval on government funding for abortion coverage in direct conflict with longstanding policy. I ask them to reverse course in any future votes to move this deadly bill forward."

United States Transfers 12 Guantanamo Bay Detainees to Afghanistan, Yemen and the Somaliland Region

WASHINGTON, Dec. 20 /PRNewswire-USNewswire/ -- The Department of Justice today announced that 12 detainees have been transferred from the detention facility at Guantanamo Bay to Afghanistan, Yemen and the Somaliland region.


As directed by the President's Jan. 22, 2009 Executive Order, the interagency Guantanamo Review Task Force conducted a comprehensive review of each of these cases. As a result of that review, which examined a number of factors, including potential threat, mitigation measures and the likelihood of success in habeas litigation, the detainees were approved for transfer. In accordance with Congressionally-mandated reporting requirements, the Administration informed Congress of its intent to transfer the detainees at least 15 days before their transfer.


Over the weekend, four Afghan detainees, Abdul Hafiz, Sharifullah, Mohamed Rahim and Mohammed Hashim, were transferred to the Government of Afghanistan. In addition, two Somali detainees, Mohammed Soliman Barre and Ismael Arale, were transferred to regional authorities in Somaliland. Finally, six Yemeni detainees, Jamal Muhammad Alawi Mari, Farouq Ali Ahmed, Ayman Saeed Abdullah Batarfi, Muhammaed Yasir Ahmed Taher, Fayad Yahya Ahmed al Rami and Riyad Atiq Ali Abdu al Haf, were transferred to the Government of Yemen.


These transfers were carried out under individual arrangements between the United States and relevant foreign authorities to ensure the transfers took place under appropriate security measures. Consultations with foreign authorities regarding these individuals will continue.


Since 2002, more than 560 detainees have departed Guantanamo Bay for other destinations, including Albania, Algeria, Afghanistan, Australia, Bangladesh, Bahrain, Belgium, Bermuda, Chad, Denmark, Egypt, France, Hungary Iran, Iraq, Ireland, Italy, Jordan, Kuwait, Libya, Maldives, Mauritania, Morocco, Pakistan, Palau, Portugal, Russia, Saudi Arabia, Spain, Sweden, Sudan, Tajikistan, Turkey, Uganda, United Kingdom and Yemen.

Derek Jeter Named 2009 Sports Illustrated Sportsman of the Year

NEW YORK, Nov. 30 /PRNewswire/ -- Sports Illustrated Group Editor Terry McDonell announced today that Derek Jeter is the 2009 Sports Illustrated Sportsman of the Year. Jeter is the first New York Yankee to receive this award. Previous winners include Muhammad Ali, Lance Armstrong, Michael Jordan, Jack Nicklaus and Tiger Woods. The 2009 SI Sportsman of the Year issue hits newsstands Wednesday, December 2. The issue marks the 11th cover appearance for Jeter.

Since 1954 the Sports Illustrated Sportsman of the Year has been presented annually to the person who excelled in athletic performance and demonstrated great character. "Over all the years SI editors have used the same language to define the award," said McDonell. "It is not for the victory alone that he (or she) is honored; rather, it is for the quality of his effort and the manner of his striving.' And that defines Derek Jeter."

Jeter's selection caps another outstanding season for the 35-year-old team captain and future Hall of Famer. In 2009 he batted .334 while leading the Yankees to their fifth World Series title in his 14 full seasons, their first since 2000 and their major league record 27th. On September 11, Jeter got his 2,722 hit, breaking Lou Gehrig's 70-year-old franchise record. Jeter now has 2,747. In 2009, Jeter led the American League by reaching base 289 times, finished second in the league in hits (212), third in batting average and on-base percentage (.406), fourth in runs (107), and eighth in stolen bases (30). He was named an All-Star for the 10th time, including the sixth time as a starter, while winning his fourth AL Silver Slugger as the best hitting shortstop in the league, and his fourth Gold Glove as the league's top defensive shortstop.


In 14 postseason games Jeter lived up to his reputation as a clutch player, batting .344 with a .432 on-base percentage, three home runs and six RBIs. He batted .407 in the World Series to help lead the Yankees to a six-game victory against the defending world champion Philadelphia Phillies. During the Series Jeter was named the American League recipient of the Hank Aaron Award, given to the best hitter in each league as voted on by the fans, and the winner of the Roberto Clemente Award, given to the player who best displays skill on the field while giving back to the community off it.

Jeter is the 10th baseball honoree and only the third in the last 34 years.
